Terms of Service

1.1 Eligibility

You must be at least 13 years old to use Flourish Institute services. By using the Service, you represent and warrant that you meet this age requirement. For users under 18 years of age, you confirm that you have your parent's or legal guardian's permission to use our services.

1.2 Account Registration

To access certain features of our services, you may need to register for an account. You agree to provide accurate and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

1.3 Prohibited Activities

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the operation of the Service
• Attempt to gain unauthorized access to the Service or its related systems or networks
• Use the Service to transmit any viruses, malware, or other harmful code
• Reverse engineer, decompile, or disassemble any part of the Service
• Engage in behavior that is harmful, offensive, or disruptive to other students or staff

2.1 User Content

You may have the opportunity to submit, post, or display content through our services ("User Content"), such as homework submissions, questions, or comments. You retain ownership of your User Content, but you grant Flourish Institute a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display your User Content in connection with the operation of our services.

2.2 Content Standards

You agree that your User Content will not infringe on the intellectual property rights of others, be defamatory, obscene, or offensive, and will not promote violence, discrimination, or illegal activities.

5.1 Disclaimers

Flourish Institute services are provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding our services, including but not limited to the accuracy, reliability, or availability of the services.

5.2 Limitation of Liability

To the maximum extent permitted by law, Flourish Institute and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from our services
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party
• Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content

7.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles.

7.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the use of Flourish Institute services shall be resolved through binding arbitration in accordance with the rules of the ADR Institute of Canada. The arbitration shall take place in Toronto, Ontario, and the arbitrator's decision may be enforced in any court of competent jurisdiction.
